Jimmo Implementation Update: Where Is CMS?

The Settlement Agreement in Jimmo v. Sebelius, No. 5:11-CV-17 (D. Vt) was approved by a federal district court in January 2013. Unfortunately, more than six years since the Settlement’s approval, the Center for Medicare Advocacy still regularly hears from beneficiaries facing erroneous “Improvement Standard” denials in home health, skilled nursing facility, and outpatient therapy settings. Secretary’s Motions Denied in Class Action Seeking Appeal Right of Observation Status Designation of Hospitalized Medicare Recipients (D. Conn.)

Several Medicare beneficiaries or their estates filed a class action to require the Secretary of Health and Human Services to afford them a process to challenge the decision when they are hospitalized to admit them either as inpatients or place them on observation status. WHAT? My Medicare coverage is ending when?!?!

The most feared words to nursing home resident or an individual receiving outpatient care or in-home care is that his or her Medicare coverage is ending. Providers are only required to give a two day notice to the Medicare beneficiary, and the news of coverage ending often comes as a surprise. This is especially true upon admission to a skilled nursing facility, as it is presented that he or she will receive up to 100 days of Medicare coverage. They key words are up to 100 days.
